This Information Text is prepared by NİFA DENT AĞIZ VE DİŞ SAĞLIĞI ANONİM ŞİRKETİ (hereinafter referred to as “Clinic”) in the capacity of data controller, in compliance with the provisions of the Personal Data Protection Law No. 6698 (hereinafter referred to as “PDPL”) and other relevant legislation, to inform you, our patients (service recipients) and consultants (potential service recipients), about the processing, purposes of processing, transfer purposes, processing duration, identity of the data controller, legal reasons for data collection, collection method, and other rights of the data subject (data owner) regarding your personal and special category personal data within the scope of PDPL.

1. Data Controller

The Clinic, located at Kazımdirik 372/32 SK NO: 3 35100 Bornova/İzmir, is the Data Controller. The concept of data controller refers to the natural or legal person responsible for establishing and managing the data recording system by determining the purposes and means of processing personal data.

Identity Data: Name, Surname, Identity Number/Passport Number, Nationality Information, Date of Birth/Age Information, Gender, Patient Protocol Number, Parent’s Name and Surname

Financial Data: Bank IBAN Number, Credit Card Transaction and Invoice Information

Physical Space Security Data: Camera Records

Health Information Data: Applied and/or Planned Treatment Method, Diagnosis and Diagnosis Information, Medical History Information, Prescription and Medication Information, Examination and Appointment Information, Temperature Measurement Information, HES Code Information

Visual and Audio Records: Photographs

Professional/Education Data: Education/Job Status

3. Your personal data will be processed by us for the following purposes:

  • Fulfillment of legal obligations and conducting activities in compliance with the legislation
  • Protection of public health, conducting preventive medicine, medical diagnosis, treatment, and care services, planning, and managing the financing of health services
  • Conducting financial and accounting transactions
  • Ensuring physical space security
  • Conducting communication activities
  • Conducting and supervising the Clinic's business activities
  • Conducting Occupational Health and Safety activities
  • Providing appointment information and responding to requests, primarily managing customer relations processes
  • Providing information to authorized persons, institutions, and organizations
  • Following and conducting legal affairs to fulfill the obligation of proof in potential future legal disputes.

4. Transfer of Your Personal Data and Purposes

In accordance with the conditions specified in Articles 8 and 9 of PDPL, your personal data may be transferred by our Clinic to:

  • Provide health and treatment services and conduct consultation processes
  • Conduct financial and accounting transactions
  • Fulfill legal obligations and provide information requested by regulatory/supervisory public institutions and authorities and official authorities
  • Plan and execute the Clinic's activities and ensure the legal, technical, commercial, and business security of the Clinic and related persons with whom the Clinic has a business relationship

Your personal data may be transferred to legally authorized public institutions and authorities (such as the Ministry of Health and its sub-units, Social Security Institution, Judicial Authorities, etc.), business partners, real persons or private law legal entities from whom we receive consultancy, including financial advisors and lawyers, primarily within the country and abroad.

5. Method and Legal Reason for Collecting Personal Data

The personal data mentioned above, including Identity, Contact, Financial, Health, Visual and Audio Records, and Professional/Education Data, will be collected through documents and forms shared/filled by you, through electronic environments such as our website, contact numbers, social media platforms, and applications downloaded to smartphones, as well as through physical/manual environments. Your data related to Physical Space Security will be collected via camera devices. The legal reasons for collecting and processing your personal data are specified under the processing conditions mentioned in Articles 5 and 6 of PDPLas follows:

  • It is expressly provided for by the laws
  • It is necessary to protect the life or physical integrity of the person who is unable to express his consent due to actual impossibility or whose consent is not legally valid
  • It is necessary for the performance of a contract to which the data subject is a party
  • It is mandatory for the data controller to fulfill its legal obligation
  • The data subject has made the data public
  • It is necessary for the establishment, exercise, or protection of a right
  • It is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject
  • Your health data is processed for the purposes of protecting public health, conducting preventive medicine, medical diagnosis, treatment, and care services, planning and managing the financing of health services, or based on your explicit consent without harming your fundamental rights and freedoms, for the purposes stated in this Information Text to provide our services within the determined legal framework.

6. Duration of Processing Your Personal Data

Your personal data obtained for the purposes mentioned above will be stored limited to the period required by relevant legislation. Accordingly, your personal data will be deleted, destroyed, or anonymized if the personal data processing conditions specified in Articles 5 and 6 of PDPL cease to exist or if you withdraw your explicit consent.

Other Rights of the Data Subject as Stated in Article 11 of the Law Pursuant to Article 11 of PDPL, you can exercise the following rights:

  • Learn whether your personal data is processed
  • Request information if your personal data has been processed
  • Learn the purpose of processing your personal data and whether they are used in accordance with the purpose
  • Know the third parties to whom your personal data is transferred domestically or abroad
  • Request the correction of incomplete or incorrect processing of your personal data
  • Request the deletion or destruction of your personal data under the conditions provided for in Article 7 of PDPL
  • Request notification of the correction, deletion, or destruction operations carried out to third parties to whom your personal data has been transferred
  • Object to the occurrence of a result against you by analyzing your processed data exclusively through automated systems
  • Request the compensation of the damage if you suffer damage due to the unlawful processing of your personal data
